1. Overview

Tonit Media Solutions Inc. (“Tonit”) is committed to protecting your personal information in compliance with applicable regulations and laws. Tonit holds your privacy in high regard and respects your concern about the security of information you choose to submit to Tonit’s website and related mobile applications (the “Site”) during your access and use of the services available on the Site, including, without limitation, the services that enable you to receive information and maps about motorcycle routes and meetups in various regions (the “Services”), and any information, data, text, graphics, photos, videos or other materials uploaded, downloaded or available on or through the Site (collectively, the “Content”). Our privacy policy (the “Privacy Policy”) explains the personal information we collect, the purpose for its collection, how we use and share it, our retention of the personal information and how you may contact us regarding your personal information. Please also read our Terms of Services which sets out the terms governing the Services.

2. Information Tonit Collects

When a user sets up an account with Tonit to access and use the Services, we collect certain personal information about the user that is required to access and use the Services. Tonit collects information about you, including information that directly or indirectly identifies you, if you or other users so choose to share it with Tonit. We receive information from you in various ways depending on how you interact with the Site (for example, we track your geo-location when you upload a route or trip using the Services). We collect this information to provide you with the opportunity to share information about yourself and your activities. The following are ways we collect information to enhance your Tonit experience: Tonit collects basic account information, such as your name, email address, username, password and social media identification should you sign-in via one of your social media accounts. Tonit uses your basic account information alongside or together with other information to allow access to our Services. For example, we use your age to verify that you can lawfully access our Services, and we use your email address to communicate with you. Tonit collects profile, Content and Site usage information when you choose to upload or post on Tonit. For example, when you post comments, photos or route/journey information (Tonit may collect the: date, time and geo-location of that post as well as your speed and distance if applicable). To record your ride and to provide you with your trip statistics and inclusion in Tonit’s Service features, Tonit collects your location information when you sign up for and use our Services. For example, when you share your journey or route, it is necessary to collect and record the physical location of your device including data such as speed and direction. Tonit gives you the choice to sign up and log into the Services using third party accounts and services, such as Facebook (collectively: “Third party Accounts”). We will collect information you have agreed to make available on those Third party Accounts if you access our services with a Third party Account (for example, your name, email address, profile information and preferences from that Third party Account). This information is collected by the Third party Account provider and is passed through to Tonit. To control the information Tonit receives from Third party Accounts, you must do so through the privacy settings of that Third party Account. Similar to other Website and mobile application operators, we collect information your browser, computer, or mobile device sends us when you access or use the Services. The type of information these devices may send us includes your network information, cookies, log files, your IP address, browser type, your time in the Site, date and time stamp of your visit to the Site, the pages of the Site that you visit and other usage data (“Usage Data”).

3. Cookies and Similar Technologies

“Cookies” are small data files that are placed on a web user’s hard drive. Cookies make accessing websites more efficient by storing information about your preferences for a particular site on your hard drive. The use of cookies is an industry standard, and when you access Tonit’s Services, a cookie will be stored on your computer. Cookies will identify your computer but will not personally identify users. Generally internet browsers are set to accept cookies, however you may change your cookies settings on your internet browser or mobile device. Please note that should you choose to reject cookies, some of the features and functionality of the Services may not work.

4. Log Files

Usage Data collected is used to analyze trends, administer, protect and secure the Services we provide. In addition, Tonit may use third party services such as Google Analytics to collect, monitor and analyze how our Services are used and to help us improve the Services.

5. How Tonit Uses Information

Tonit will only use the personal information it collects to deliver and improve upon the Services. To participate in Tonit’s Services, some information about you will be shared, such as your profile, username, photos and activities (for example when you post photos, or send chat messages). We collect this information to improve our Services, and to communicate with users. We may communicate with you when you send us an inquiry, or to inform you about updates, new features or to send marketing communications (where you have agreed to receive such messages). Tonit is committed to using your information in ways that will enhance your experience with our Services. Tonit may de-identify or aggregate the Usage Data in ways that do not personally identify you. Examples of such aggregated information or statistical data include Usage Data, demographics, routes and journeys. Information about you that is no longer necessary and relevant to provide our Services may be de- identified and aggregated with other non-personal data to provide insights which are commercially valuable to Tonit, such as statistics of the use of the Services. For example, we may retain publicly available segments or routes and other depersonalized geo-location information to continue to improve the Services. This information will be de-associated with your name and other identifiers. If you do not wish Tonit to collect Usage Data do not access or use the Site or Services.

6. How Information is Shared

We may share your Usage Data with third party service providers who provide Services to Tonit such as supporting and improving the Services and marketing the Services. These service providers will only have access to the information necessary to perform these limited functions on our behalf and are required to protect and secure your information in compliance with applicable law. Tonit does not share or sell your personal or contact information to third parties for any commercial purpose whatsoever. We may also engage service providers to collect information about your use of the Services over time on our behalf so that we or they may promote Tonit or display information that may be relevant to your interests on the Services or other websites. If you decide to use third party apps, plug-ins or websites that integrate with the Services (such as logging on to our Services with your Facebook account), they may receive your information and Content, including your personal information, photos and your activity data (including private activities). Any information or Content collected by these third-parties is subject to their terms and policies. Please read any applicable third party terms and policies before accessing our Services through a third party app, plug-in, website or otherwise. Tonit is not responsible for the terms or policies of third parties. Tonit may preserve or disclose your information if we determine that it is reasonably necessary to comply with the law, regulation, legal process or governmental request. Tonit reserves the right to retain and share your information (even from deleted accounts) to protect the safety of any other person; to protect our users’ rights or property; to address fraud, security or technical issues; and to prevent or detect violations of our Terms of Service. Generally, Tonit only retains your information for as long as it is necessary to provide the Services to you and others, or for such further time as may be required by applicable law. If your account is deleted, it may take up to 30 days to fully delete your personal information and system logs from our systems, unless we are required for any reason mentioned within this Privacy Policy to retain such information for a further amount of time. Notwithstanding any intention to the contrary, this Privacy Policy is not intended to limit any legal rights that you may have respecting any third party request (including government agency or via legal process) of Tonit to disclose your information.

7. Links to Other Websites

Our Site may contain links to third party websites. We neither control nor endorse third party sites and we are not responsible for the content of such sites. Any information you provide to third party sites, including personal information, is subject to the privacy policies of those third party sites.

Managing Your Settings

8. No Privacy Settings

Presently Tonit features do not enable you to manage how much information you wish to share with other users. ALL CONTENT POSTED ON TONIT IS PUBLIC AND CAN BE READ BY ANYONE.

9. Tonit communications to Users

Tonit communicates with users by posting notices on the Site, through push notifications, in-application (‘in-app’) notifications and via direct email using the email address provided to Tonit in setting up the user account. A user has no control over push-notifications or in-app notifications as these messages are for the purpose of providing users with necessary operational information concerning access and use of the Site and Services. Users may opt-out of Tonit marketing messaging, which are only communicated via email, by clicking on the ‘unsubscribe’ link provided at the bottom of each such email.

10. Deleting Information and Accounts

A user can go to Settings > Account > Delete account to disable the user account from all Tonit systems. Once deleted, your data, including your account and activities cannot be reinstated. Note that all Content you have posted on the Site or shared with other users (for example, through groups or chat messages) or that other users have copied may also remain visible after you have deleted your account or deleted the information from your own profile. Your public profile may be displayed in search engine results until the search engine refreshes its cache.

11. Data Residency

Tonit stores all information collected from its users, including personal information, on servers and with service providers located in the United States of America (“USA”). As a result, the information your provide to Tonit, including personal information, and your Content, is subject to the laws of the USA including the USA Patriot Act (https://www.justice.gov/archive/ll/highlights.htm) and therefore may be made available to the US government or its agencies under a lawful order made in the USA. If you do not wish your information, including personal information, to be subject to disclosure to the US government you do not use Tonit.

12. Security

Tonit is committed to protecting your personal information and Tonit has implemented reasonable security measures to prevent unauthorized access, collection, use, disclosure, copying, modification or disposal of your personal information. However, no data transmissions over the Internet can be guaranteed to be absolutely secure. To help ensure the security of your private information, you should be aware of the security features available to you through your browser or mobile device.

13. Acceptance, Consent and Changes

By accessing the Site and Services you consent to our collection, use, disclosure, retention and deletion of your information (including personal information) in accordance with the terms and conditions expressed herein. Tonit reserves the right to change or amend this policy to reflect changes in the law, best practices, Tonit’s governance of your personal information or for any other reason. Tonit will make reasonable efforts to inform you of any material changes to this Privacy Policy, and you nonetheless understand and agree that it is your responsibility to check this Privacy Policy to ensure you understand and agree to the terms currently in force and effect each time you access or use the Site or Services. By continuing to access or use our Services after changes have been made to our Privacy Policy, you agree to be bound by the revised Privacy Policy. If you disagree with or object to any of this Privacy Policy or future changes we may make, you should STOP using the Services and delete your account.
